The Announcement of King Mongkut’s University of Technology Thonburi on Rights to Intellectual Property Originated by Graduate Students, B.E. 2549 (2006)

To be enacted commencing on the second semester of the academic year B.E. 2549 (2006). For the improvement of guidelines for signing an agreement on Copyright Transfer of Graduate Thesis of King Mongkut’s University of Technology Thonburi, the announcement of King Mongkut’s University of Technology Thonburi on Guidelines to Signing an Agreement on Copyright Transfer of Thesis, B.E. 2544 (2001) on the 16 th October B.E. 2544 (2001) is repealed. The University Council on its 7/2549 th meeting on the 24 th July B.E. 2549 (2006) declared the announcement of King Mongkut’s University of Technology Thonburi on Rights to Intellectual Property Originated by Graduate Students, B.E. 2549 (2006) as follows:

     
    1.  
Applications means original works which students of King Mongkut’s University of Technology Thonburi create or design during the time they study at the university; for example, inventions, independent studies, thesis of graduate students, thematic papers, research projects, research-based projects, etc. The applications will be counted as a part of the program study of the university, and the university will own the rights to intellectual property.
    2.  
If the students desire to promote their applications as referred in item 1 in any publications, a declaration on application status belonging to King Mongkut’s University of Technology Thonburi must be presented clearly in all publications.
    3.  
Permission in writing from the university must be given before students promote their application as referred in item 1 or allow any persons to reproduce, modify, publicize or use the application for other performances for remuneration or business purposes based on the Copyrights Act B.E. 2537 (1994).
    4.  
Permission in writing from the university must be given before students take their applications as referred in item 1 to develop or extend into other types of inventions or intellectual property within 10 years after the date of graduation. The University shall hold ownership of intellectual property, shall commercially license permission to use copyrights, and shall allocate any benefits received from the utilization of new partial applications or total applications in the future based on the Regulation of King Mongkut’s University of Technology Thonburi on the Management of Benefits Originated by Intellectual Property, B.E.2538 (1995).
    5.  
The benefits from applications as referred in item 1 and/or 4 shall be allocated to the students who create those applications in accordance with the rates indicated in the Regulation of King Mongkut’s University of Technology Thonburi on the Management of Benefits Originated by Intellectual Property, B.E. 2538 (1995).
    6.  
Signing agreements on copyright transfer as referred in item 1 shall be done commencing on the day thesis proposals are approved. If there are any corrections or changes to the thesis title, a newly signed agreement shall be made.
    7.  
If students are granted scholarships for study and research from external scholarship resources and those scholarship resources have conditions in writing of being co-copyrighters, the agreements on the transfer of applications originated by the grant for study and research from external scholarship resources shall be deposited into the university and those scholarship resources.
    8.  
The Dean of each faculty shall sign for receipt of copyright transfer of thesis and intellectual property in the form of Power of Attorney of the university.
    9.  
Advisors and/or co-advisors and/or staff of faculty shall sign as witness in the Agreement on Copyright Transfer of Intellectual Property of Graduate Students.
    10.  
The Agreement on Copyrights Transfer of Intellectual Property of Graduate Students shall be identified at the end of the thesis.
    11.  
Graduates and international students shall keep copies of the Agreement on Copyright Transfer of Thesis and Intellectual Property.
    12.  
The judgment of the President on problems relating to Intellectual Property is considered final.
    13.  
This announcement shall be enacted commencing on the second semester of the academic year B.E. 2549 (2006).
